General Petition Information Abstract: | Josephina Selina Hart, wife of Simon Schloss, seeks to be declared the lawful owner, together with her sister Louisa Hart, of a slave named Dick. Josephina Hart Schloss, represents that, in 1824, she and Louisa became the owner of four slaves, who were purchased from their mother, Rachal Levy of Charleston. One of the slaves, named Sophia, had three children at the time of the transfer of ownership; she later gave birth to a son named Dick. Josephina contends that she and Louisa continued to jointly own Dick until 1851, when Rachal Levy, “disregarding” her daughters’ title to the slave, sold him to Simon Schloss, Josephina’s husband. Soon thereafter, Schloss mortgaged Dick to secure a debt. Dick was eventually seized by the sheriff and sold to satisfy a judgment obtained against Schloss by one Alexander Loupe. Josephina Hart Schloss claims that, even if her husband’s claim to Dick’s title were to prevail, she has a privilege on Dick because her husband owes her money. She explains that she and Simon Schloss were separated in property in 1851 and Schloss was ordered to pay her $8,000, from which $2,000 remains unpaid. Schloss, however, has no property on which Josephina can stake her claim. Josephina therefore prays that Alexander Loupe, Simon Schloss, her sister Louisa Hart, and Sheriff James P. Freret be cited to answer her petition. She prays that Alexander Loupe be condemned to return Dick and that she and her sister be declared the slave’s true and lawful owner. If Dick cannot be returned, she wants the sheriff to pay the price for which he was sold. |
